Storyhorse, LLC d/b/a Thoroughbred (hereinafter “Thoroughbred,” “we,” “us,” or “our”) respects your privacy. If we send marketing text messages, you may opt out by following the instructions provided in the applicable text message, such as replying “STOP.” Message and data rates may apply. Consent to receive marketing communications is not a condition of purchasing goods or services. Thoroughbred does not sell personal information for monetary consideration in the ordinary course of its business. California residents may also designate an authorized agent to submit a request on their behalf, subject to applicable verification requirements.
b. Colorado. If you are a Colorado resident and the Colorado Privacy Act (“CPA”) applies to Thoroughbred, you have rights to access, correct, delete, and obtain a portable copy of personal data, as well as rights to opt out of certain targeted advertising, sale of personal data, or profiling. c. Connecticut. Delaware residents may also designate an authorized agent to submit a request on their behalf, subject to applicable verification requirements.
e. Florida. If you are a Florida resident and the Florida Digital Bill of Rights (“FDBR”) applies to Thoroughbred, you may have certain rights concerning your personal data, including applicable rights to know, access, correct, delete, obtain a copy of data, and opt out of certain sales, targeted advertising, profiling, collection of personal sensitive data, including through geolocation and voice or facial recognition. Thoroughbred will not discriminate against you for exercising an INCDPA consumer right, including denying goods or services, charging different prices or rates for goods or services, or providing a different level of quality of goods or services to you.
g. Iowa. If you are an Iowa resident and the Iowa Consumer Data Protection Act (“ICDPA”) applies to Thoroughbred, you may have rights to know, access, delete, and obtain a copy of certain personal data and to opt out of certain sales of personal data or targeted advertising. Thoroughbred will not discriminate against you for exercising an ICDPA consumer right, including denying goods or services, charging different prices or rates for goods or services, or providing a different level of quality of goods or services to you.
h. Kentucky. If you are a Kentucky resident and the Kentucky Consumer Data Protection Act applies to Thoroughbred, you may have rights to access, correct, delete, and obtain a copy of personal data and to opt out of certain targeted advertising, sales, or profiling. Thoroughbred will not retaliate or discriminate against you for exercising your rights under the Kentucky Consumer Data Protection Act, including denying goods or services, charging different prices or rates for goods or services, or providing a different level of quality of goods or services to you.
i. Louisiana. If you are a Louisiana resident and the Louisiana Data Privacy Act applies to Thoroughbred, you may have the right to confirm, access, correct delete, and obtain a copy of personal data where technically feasible, as well as to opt our of processing for targeted advertising, sale of personal data, or profiling. j. Maryland. If you are a Maryland resident and the Maryland Online Data Privacy Act (“MODPA”) applies to Thoroughbred, you may have rights concerning the collection, use, disclosure, and processing of personal data, including applicable rights to access, correct, delete, obtain a copy of personal data, and opt out of certain processing, targeted advertising, and sales. Thoroughbred will not discriminate against you for exercising an MODPA consumer right, including denying goods or services, charging different prices or rates for goods or services, or providing a different level of quality of goods or services to you. k. Minnesota. If you are a Minnesota resident and the Minnesota Consumer Data Privacy Act (“MCDPA”) applies to Thoroughbred, you may have rights to know, access, correct, delete, and obtain a copy of personal data and to opt out of certain targeted advertising, sales, or profiling. Thoroughbred will not discriminate against you for exercising an MCDPA consumer right, including denying goods or services, charging different prices or rates for goods or services, or providing a different level of quality of goods or services to you.
l. Montana. If you are a Montana resident and the Montana Consumer Data Privacy Act (“MCDPA”) applies to Thoroughbred, you may have rights to access, correct, delete, and obtain a copy of personal data and to opt out of certain targeted advertising, sales, or profiling. Thoroughbred will not discriminate against you for exercising an MCDPA consumer right, including denying goods or services, charging different prices or rates for goods or services, or providing a different level of quality of goods or services to you.
m. Nebraska. If you are a Nebraska resident and the Nebraska Data Privacy Act (“NDPA”) applies to Thoroughbred, you may have rights to access, correct, delete, and obtain a copy of personal data and to opt out of certain targeted advertising, sales, or profiling. o. New Jersey. If you are a New Jersey resident and the New Jersey Data Privacy Act (“NJDPA”) applies to Thoroughbred, you may have rights to access, correct, delete, and obtain a copy of personal data and to opt out of certain targeted advertising, sales, or profiling. Thoroughbred will not discriminate against you for exercising an NJDPA consumer right, including denying goods or services, charging different prices or rates for goods or services, or providing a different level of quality of goods or services to you. p. Oklahoma. If you are an Oklahoma resident and the Oklahoma Consumer Data Privacy Act applies to Thoroughbred, you may have rights to confirm, correct, delete, and obtain a copy of personal data to the extent technically feasible, or opt out of certain targeted advertising, sales, or profiling. r. Rhode Island. If you are a Rhode Island resident and the Rhode Island Data Transparency and Privacy Protection Act applies to Thoroughbred, you may have right to access, correct, delete, and obtain a copy of certain personal information, and to opt out of certain targeted advertising, sales, and profiling. Thoroughbred will not discriminate against you for exercising a RIDTPPA consumer right, including denying goods or services, charging different prices or rates for goods or services, or providing a different level of quality of goods or services to you. However, if you opt out of data collection, Thoroughbred is not required to provide a service that requires such data collection. s. Tennessee. If you are a Tennessee resident and the Tennessee Information Protection Act (“TIPA”) applies to Thoroughbred, you may have rights to access, correct, delete, and obtain a copy of certain personal information and to opt out of certain sales of personal information, targeted advertising, or profiling. Thoroughbred will not discriminate against you for exercising a TIPA consumer right, including denying goods or services, charging different prices or rates for goods or services, or providing a different level of quality of goods or services to you.
t. Texas. If you are a Texas resident and the Texas Data Privacy and Security Act (“TDPSA”) applies to Thoroughbred, you may have rights to access, correct, delete, and obtain a copy of personal data (up to two times annually) to the extent technically feasible, and to opt out of certain targeted advertising, sales, or profiling. Texas residents may also designate an authorized agent to submit a request on their behalf, subject to applicable verification requirements.
u. Utah. If you are a Utah resident and the Utah Consumer Privacy Act (“UCPA”) applies to Thoroughbred, you may have rights to access and delete certain personal data and obtain a copy of certain personal data, as well as rights to opt out of certain targeted advertising or sales of personal data. v. Vermont. If you are a resident of Vermont, you may have the right to access, correct, delete, or obtain a copy of your personal data, as well as rights to opt out of targeted advertising, sales, and profiling. If data profiling results in any decision, you have the right to question the result, be informed of the reason the profiling resulted in such a decision, and review the personal data processed for the purposes of such profiling. w. Virginia. If you are a Virginia resident and the Virginia Consumer Data Protection Act (“VCDPA”) applies to Thoroughbred, you may have rights to access, correct, delete, and obtain a copy of personal data, as well as rights to opt out of certain targeted advertising, sales of personal data, or profiling. x. Other States. Residents of states not specifically identified above may have privacy, data-security, or consumer-protection rights under applicable state or federal law. Thoroughbred will comply with applicable legal requirements concerning personal information and will provide any additional rights or disclosures required by applicable law.
11. Changes to This Privacy Policy. Thoroughbred reserves the right to change or modify this Privacy Policy at any time. A notice of any material change will be posted on runwiththoroughbred.com for a period of thirty (30) days.
12. Terms of Use. If you choose to provide your personal data to Thoroughbred, your action is hereby deemed acceptance of Thoroughbred’s practices described in this policy statement. Any dispute over privacy between you and Thoroughbred is subject to the provisions of this notice and to Thoroughbred's Terms and Conditions of Use Agreement which is hereby incorporated herein and which can be read at runwiththoroughbred.com.
